What the NJ PFAS Settlement Means for TX Water Systems

August 7, 2025

New Jersey Just Secured $2.5B for PFAS Contamination—Texas Is Right Behind

In recent months, New Jersey reached two historic settlements with PFAS manufacturers:

  • $450 million from 3M in May 2025
  • Up to $2 billion from DuPont, Chemours, and Corteva August, 4th 2025

These cases alleged decades of groundwater and natural resource contamination from PFAS used in manufacturing, firefighting foam, and consumer products.  And the settlement money will be used for remediation, treatment, and source water protection.

These aren’t isolated events. Texas is already on the same path.

Texas: From Litigation to Likely Settlements

Several major lawsuits are underway across the Lone Star State:

  • Texas Attorney General Lawsuit (Dec 2024): AG Ken Paxton sued 3M and DuPont for deceptive trade practices related to PFAS.
  • City of Fort Worth Lawsuit (Mar 2025): Suing for $420 million in damages due to PFAS in the municipal water supply.
  • City of Dallas Lawsuit (April 2025): Filed claims against major chemical companies for PFAS-related contamination.
  • Texas Farmers Lawsuit (Feb 2024): Alleging land and livestock contamination from biosolid-based fertilizers.

No settlements have been finalized yet, but the pressure is building—and these cases mirror the exact path New Jersey took before securing billions.

What’s Driving the PFAS Crackdown?

The EPA recently published drinking water limits of just 4 parts per trillion for PFOA and PFOS, with other PFAS compounds under review. Meanwhile, public awareness is rising and legal liability is expanding across:

  • Drinking water providers
  • Wastewater treatment plants
  • Rural water systems
  • Industrial dischargers
  • Engineering and consulting firms
